Preliminary Provisions
By accessing and using Jagad Services, the User confirms that they have read, understood, and agreed to these Terms and Conditions. Users agree to read, acknowledge, and consent to the terms outlined in Jagad’s Privacy Policy, which governs the collection, use, disclosure, and protection of personal data in relation to the use of the Platform and Services. Jagad reserves the right to amend these Terms and Conditions at any time. Changes will be communicated to Users via email or notifications on the Platform or Services. These changes become effective once published. Continued use of the Services following such changes constitutes acceptance of the amended Terms. Users may terminate their use of the Services at any time by deleting their Account. Jagad also reserves the right to suspend or terminate access if the User is found to be in breach of these Terms and Conditions.
Definitions
Jagad: PT Jagadraya Jaring Terdistribusi, the provider of decentralized blockchain wallet services (J-Wallet) and related platform.
JIDR: A token that represents Fiat Rupiah, is unique in nature, and is exclusively available within the ecosystem, Platform, and Services owned by Jagad
Users: Any individual or business entity using Jagad Services.
Services: Features and functionalities provided by Jagad through the Jagad.to platform, including but not limited to J-Wallet.
Account: A unique identifier created by the User to access and use the Services offered by the Platform.
Personal Information: Data that directly or indirectly identifies the User, as described in Jagad’s Privacy Policy.
Platform: All websites, applications, and related technologies provided by Jagad.
Privacy Policy: The document that governs how Jagad collects, uses, stores, discloses, and protects
users’ Personal Information in connection with the use of the Platform and Services, as may be amended
from time to time and made available on the Platform and/or Services, or can be accessed to the following
Terms and Conditions: All provisions, rules, policies, and guidelines governing the use of the Platform and Services provided by Jagad, as may be amended from time to time, and which constitute a legally binding contract upon the Users.
Account Registration and Verification
Users must be at least 18 years old.
Users are required to register and create an Account to access the Platform and Services.
Users must undertake and complete the verification process as reasonably requested and required by Jagad in accordance with applicable regulations, in order to comply with anti-money laundering (AML) and counter-terrorism financing (CTF) regulations.
Users shall ensure that all data, information, and documents provided during the verification process are accurate, correct, up to date, not misleading, and free from viruses, malware, or any files that may interfere with the normal operation of the Platform or Services
Users must update their information if changes occur and agree to undergo additional verification if requested.
Failure to complete the verification process may result in Account restriction, Account suspension, or access termination to Account.
Users must maintain the confidentiality of their login data (credentials, private keys, and others) and security of all Account credentials.
Use of Services
Users are responsible for ensuring that their use of Jagad Services complies with all applicable laws and regulations in their jurisdiction.
Users must comply, at all times, with applicable local and international laws, regulations, and regulatory requirements relevant to the use of the Platform and Services, including but not limited to financial, tax, AML CTF, intellectual property rights, and data protection laws.
Users accept full responsibility for any actions carried out through their Account, as well as security of their Account.
Users shall immediately notify Jagad in the event of any malfunction or disruption of the Platform or Services.
Users must report any suspicions regarding non-compliance to the Terms and Conditions (e.g. the loss, theft, or illegal acquisition of their Account credentials or electronic device used for accessing the Platform) without delay and cease using the Platform and Services until further instruction is provided by Jagad.
Jagad shall not be liable for losses resulting from User negligence, except where proven to result from Jagad's gross negligence or wilful misconduct.
Jagad reserves the right to verify, approve, suspend, limit, or terminate access to the Platform and Services if the Users are found to violate any provisions of the Terms and Conditions, fails to meet identity verification requirements, or engages in suspicious, illegal, or unethical activities.
Jagad may amend or update the Platform, Services, features, and policies, including these Terms and Conditions, at its discretion, with or without prior notice, to comply with applicable laws or improve security and service quality.
Jagad has the right to request additional data, documentation, or verification at any time to ensure continued compliance regulatory obligations, including with AML CTF.
Jagad may report and share information with relevant authorities, regulators, or law enforcement agencies in accordance with applicable laws and regulatory obligations.
Top Up
Users may top up their digital assets or fiat using methods provided by Jagad, including integration with third-party partners such as crypto exchanges, payment service providers, or certain financial institutions.
Top up via bank transfer method may only be carried out once the User has completed the verification process.
Top up instructions must be followed exactly as provided on the Platform. Jagad is not liable for transfer errors, including but not limited to incorrect wallet addresses, wrong blockchain networks, or inaccurate amounts.
Processing time for deposits may vary depending on the asset type, blockchain network, and third-party confirmations. Jagad does not guarantee immediate fund availability.
If Users deposit digital assets, Jagad will inform them of the exchange rate between the digital asset and fiat.
Digital asset deposits via blockchain networks are irreversible. Jagad has no control over network confirmations or transaction status changes after submission.
Transaction
Users are entitled to withdraw assets from their wallets at any time, subject to applicable security procedures and identity verification requirements.
Users may conduct wallet-to-wallet transactions (J-Wallet), transactions with third parties (e-wallet or Bank), or payments to Jagad partners through features available on the Platform.
All withdrawal requests will be processed only after additional authorization (e.g., PIN confirmation).
Administrative fees may apply and will be deducted from the withdrawal amount.
Users are fully responsible for the accuracy of transaction data such as destination account, Bank name, recipient name, and amount.
Transactions with Jagad partners may be conducted via QR code scanning.
Transaction history is available on the Platform for User reference.
In certain cases, Jagad may hold or cancel transactions if:
There is a violation of law or these Terms;
A valid request is made by competent authorities;
There are system disruptions, fraud, or other suspicious activities.
Intellectual Property
All content, technology, trademarks, logos, designs, and other intellectual property related to the Platform and Services provided by Jagad are the exclusive property of Jagad or its licensors.
Users are granted a limited, non-exclusive, non-transferable, and revocable right to access and use the Platform and Services, in accordance with this Terms and Conditions.
Users may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from any part of the Platform or Services without Jagad’s prior written consent.
Data Security
Jagad may collect and process personal data, including but not limited to identity, financial, transactional, and technical information, for the purpose of providing and improving the Services, fulfilling legal obligations, and securing the Platform.
The collection, use, and protection of personal data are governed by the provisions outlined in Jagad’s Privacy Policy, which forms an integral part of these Terms.
Users data may be shared with Jagad affiliates, third-party service providers, or legal authorities in accordance with the Privacy Policy and applicable laws. Users give explicit consent for such use and data transfer.
Jagad will retain Users data only as long as necessary to fulfil the stated purposes or as required by law. Jagad implements reasonable technical and organizational measures to protect Users data integrity and security.
Users may access, correct, or request deletion of their personal data in accordance with the Privacy Policy and applicable data protection laws. Deletion requests may be sent to support@garuda.to, including the user’s wallet address for identification.
Limitations of Liabilities
The Services are provided "as is" without any warranties.
Jagad shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Services.
If Jagad is found liable, its total liability is limited to the amount paid by the User for the relevant Services.
Validity Period
All provisions in these Terms and Conditions come into effect when Users register for an Account and will remain in effect as long as the Users:
access Platform and use Services; and/or
keep their Account that has not been permanently deactivated (permanently closed).
Users hereby agree to waive the provisions in Article 1266 of the Civil Code insofar as there is a need for a court decision or court order to terminate an agreement. So that the termination of the legal relationship between Jagad and Users based on these Terms and Conditions can end or be terminated without requiring a decision or order from the court.
Force Majeure
Jagad shall not be liable for any delay or failure in the performance of obligations under this Agreement caused by circumstances beyond their reasonable control, including but not limited to natural disasters, fires, floods, earthquakes, wars, governmental actions, labor disputes, network or system failures, power or telecommunication outages, cyber-attacks, pandemics, or other national emergencies.
In the event of Force Majeure, Jagad will notify Users in writing as soon as reasonably possible and will take reasonable steps to mitigate the impact of the force majeure event.
Governing Law and Dispute Settlement
All provisions set forth in this Terms and Conditions are governed and interpreted in accordance with the Law of the Republic of Indonesia.
All disputes arising from this Terms and Conditions will be resolved amicably to reach a consensus.
If no consensus is reached, such dispute will be resolved in a district court of South Jakarta.
Users Support Services
All requests for information, complaints and claims related to Users’ Account, Jagad’s Platform or Services, as well as these Terms and Conditions must be submitted only through the User Support Service via email (support@garuda.to ) or to chatbox available in the Platform or Services.
